Terms of service
Article 1 — Seller
The website www.kitadua.com (the "Website") is operated by:
PT KITA DUA BALI
Company incorporated in Indonesia (PMA status)
Business Identification Number (NIB): 2311220164899
Registered office: Jalan Sunset Road No. 105, Seminyak, Kuta, Badung, Bali 80361, Indonesia
Email: kitaduamc@gmail.com
Hereinafter "Kita Dua" or the "Seller".
Article 2 — Scope
These terms and conditions of sale (the "Terms") apply to every order placed on the Website by an individual customer acting as a consumer (the "Customer").
Wholesale sales to businesses are not made through the Website. They are handled separately, on request through the Wholesale page.
The Customer confirms they have the legal capacity to enter into a contract. They accept the Terms by ticking the box provided before placing their order. The Terms in force on the date of the order apply.
Article 3 — Products
The products offered are women's ready-to-wear clothing and accessories, designed and handmade in Bali, while stocks last.
Each product page lists the product's main characteristics and a size guide. Usual equivalents: one size = EU 36 to 40; S = EU 36; M = EU 38; L = EU 40; S/M = EU 36-38; M/L = EU 38-40.
Some items are still being made when the order is placed. In that case, the expected shipping date is shown on the product page before purchase.
Photos are as accurate as possible. Because each piece is handmade, colour and finish may vary slightly from one piece to another.
Article 4 — Ordering
- The Customer adds products to their cart.
- They review the summary: products, sizes, quantities, prices, shipping costs.
- They enter their contact details and delivery address.
- They accept the Terms and pay.
The order is final once payment is confirmed. An order confirmation email summarising the order is then sent to the Customer.
Article 5 — Prices and payment
Prices are shown in euros (EUR) and Indonesian rupiah (IDR), excluding shipping. The amount charged is the one shown, in the currency shown, at the payment step. Shipping costs are shown before the order is confirmed.
Accepted payment methods: bank card (Xendit) and PayPal. Kita Dua never has access to the Customer's card details.
Products ship from Indonesia. Any customs duties and import taxes due in the destination country are not included in the price and are paid by the Customer. They vary by country, so Kita Dua cannot state the amount in advance. The Customer can ask their local customs office for details.
Article 6 — Shipping
Kita Dua ships worldwide from Bali.
Orders usually ship within 2 working days of payment, unless an item is still being made (see Article 3).
Estimated delivery times after shipping:
| Carrier | Destination | Time |
|---|---|---|
| DHL Express | worldwide | 3 to 5 working days |
| POS Indonesia (EMS) | France / Europe | about 10 working days |
A signature is required on delivery. The Customer receives a tracking number.
If a parcel arrives damaged or incomplete, the Customer reports it to the carrier on delivery where possible and emails Kita Dua at kitaduamc@gmail.com within 2 days of receipt, with photos, so the claim can be handled quickly with the carrier. This time limit does not affect the statutory guarantees in Article 8.
If the order is not delivered within the stated time, or at the latest 30 days after the order, the Customer may cancel the sale under Articles L216-6 et seq. of the French Consumer Code.
Article 7 — Right of withdrawal and returns
7.1 Right of withdrawal (14 days)
Under Articles L221-18 et seq. of the French Consumer Code, the Customer has 14 days from receipt of their order to withdraw from the contract without giving a reason. This right also applies to sale items.
To exercise it, the Customer sends kitaduamc@gmail.com a clear statement of their decision to withdraw, or the form in the appendix.
The Customer returns the item(s) no later than 14 days after sending their statement, in their original condition, with labels. Return shipping is paid by the Customer. A tracked service is recommended.
Refund. Kita Dua refunds all payments received, including the original delivery costs (up to the cheapest standard delivery option offered), no later than 14 days after being informed of the withdrawal, using the same payment method as the order, unless the Customer expressly agrees otherwise. The refund may be withheld until the items are received or the Customer provides proof of shipping, whichever comes first.
The Customer may be liable for any reduction in value resulting from handling beyond what is needed to establish the nature, characteristics and functioning of the items (normal trying on).
7.2 Exchange or store credit (Customer's choice)
Instead of a refund, the Customer may ask for an exchange for another item or for store credit as a discount code, valid for 6 months. For an exchange, if the new item costs more, the Customer pays the difference; if it costs less, the difference is refunded using the same payment method, or given as store credit if the Customer prefers.
Article 8 — Statutory guarantees
Regardless of any commercial guarantee, the Seller remains bound by the statutory guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code).
The Customer has 2 years from delivery to claim under the guarantee of conformity. They may obtain repair or replacement of the item or, failing that, a price reduction or cancellation of the sale. Return costs are then paid by Kita Dua.
If a product is faulty or does not match the order, the Customer emails Kita Dua at kitaduamc@gmail.com with photos.
Article 9 — Personal data
The Customer's data is used to process their order, delivery and customer service. How it is handled is described in the Website's privacy policy.
Article 10 — Intellectual property
The texts, photos, logos and designs on the Website belong to Kita Dua or are used with their owners' permission. Any reproduction without written permission is prohibited.
Article 11 — Governing law, complaints and mediation
These Terms are governed by French law.
Complaints should first be sent to Kita Dua at kitaduamc@gmail.com.
Under Articles L612-1 et seq. of the French Consumer Code, if a dispute is not resolved after a prior written complaint, the Customer may refer it free of charge to the consumer mediator:
CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice
Website: www.cm2c.net
Failing agreement, the dispute may be brought before the competent courts; the consumer Customer may always bring proceedings in the courts of their place of residence.
Article 12 — Language
These Terms are available in French and English. In case of discrepancy, the French version prevails.
